ENVIRONMENT / SITUATION

The manifest increase in the frequency of claims in all sectors of activity is also notoriously reflected in the healthcare field, with a constant increase in the judicialization of these claims and in the amounts claimed.

This situation has led to an increasing lack of professionals capable of providing expert opinions on health professional liability and determining the consequences of medical negligence or malpractice. In parallel, there has been a growing need for professionals capable of assessing the bodily injury arising from these complex matters.

On the other hand, insurance companies that assume health and professional liability risks, both underwriters and claims managers, as well as lawyers involved in the defense of this type of claims, need not only the support and technical contribution of the medical expert, but also a better knowledge of the expert’s work, its methodology, processes and conclusions, of the intervening parties and their functions, of the ways of collaboration and coordination of their own activity with the expert’s work, and all this to give more consistency to their task and, above all, to achieve more security and possibilities of success in the defense of their interests.

CHARACTERISTICS

In response to this manifest need and with the purpose of covering these shortages of specialized professionals, the proposal arose to combine the academic prestige of the Ortega-Marañón University Research Institute with the technical and practical experience of Criteria in the field of medical expertise to offer the market a solid postgraduate training program aimed at training and developing the knowledge, skills and techniques necessary for the preparation of expert health reports.

THE TRAINING PROGRAM HAS THE FOLLOWING CHARACTERISTICS:

It will be accessible, offered in a tutored online format, with the possibility of full online development, in order to guarantee its practical approach oriented to the practice of the profession.

It has first level academic teachers and also linked to very relevant positions in the professional practice in the field of Health Responsibility.

Each training module will have the corresponding evaluation tests required for the achievement of the degree.

The degree obtained by the candidate student who successfully passes the evaluation tests and, if applicable, successfully completes the Master’s Thesis in compliance with the academic requirements, will have a private nature and the academic support of the Instituto Universitario de Investigación Ortega-Marañón’s own degree.

OBJECTIVES

  • The main objective of the Master is to develop the necessary skills for the preparation of expert reports in the health field.
  • To understand the different judicial areas in which a medical expert can develop his activity and the procedural characteristics of each one of them.
  • To deepen in the expert methodology and its implementation.
  • Specifically develop the different types of health responsibility emphasizing the implementation of the preparation of the report.

ACADEMIC PROGRAM (MASTER’S DEGREE)

The academic program consists of 60 credits distributed in different modules that are configured as follows:

  • Introduction to health expertise (5 ECTS)
  • Evaluation of bodily injury (10 ECTS)
  • Forensic Psychiatry (7 ECTS)
  • Labor and social field (3 ECTS)
  • Traffic accident experts (2 ECTS)
  • Alternative means of conflict resolution (3 ECTS)
  • Defense of the expert report in oral proceedings (10 ECTS)
  • The program will be completed with the defense of a Master’s Thesis (12 ECTS). (12 ECTS)

METHODOLOGY

The content of the Master has been developed with an eminently practical approach to enable students to acquire and consolidate the necessary skills for the performance of expert work.

The Master will be developed in an eminently online format.

The academic content will be taught with a theoretical syllabus that will be supported and reinforced with complementary video lectures.

Each module will have an evaluation activity to assess the acquisition of competencies in relation to the content developed in each one of them.

Case studies will be presented and presented and their resolution will be provided. Case studies will also be proposed to the students for their development and learning based on real cases.

Master classes will be held periodically to complement the theoretical content and will be given by a recognized expert in the specific subject to be covered.

The final module will be conducted in a classroom format to carry out mediation and trial simulations in which each student will have to prepare a case to be defended in court. In this module, students taking the Master’s degree at a distance will be able to attend or watch the sessions in deferred mode and will be evaluated instead of the face-to-face activity.
